According to Texas law he is no murderer. The law allows a person to use force to defend their own, or a neighbor's property. And, if the accounts I read are accurate, the thieves crossed the shooter's land to access their target house.
Legally speaking the man may go free.Moral considerations may be at odds with the law, but do not count much in court. In my state,as in many, it is not legal to use deadly force in this way. Personally, I wont judge the man, as he was there,in the heat of the moment, and I was not.
